Question by sdlegal1: Maternity Leave?
I am expecting my first child in November. My work does not pay into CA State Disability. Therefore, I only receive 6 weeks of disability through our “special insurance” from the date of delivery. The catch is I have to use up my accrued vacation time first. Once I do that, I only receive two weeks of disability.
I am wondering if there are any way to receive funds/disability insurance in another manner. Can I apply for AFLAC or another comparable disability insurance plan now even though I am already pregnant? I really don’t want to put my child in daycare at 6 weeks of age. Please help!!
I am a police officer and we are exempt from state disability as a result of a union vote 10 years ago. I can’t afford to quit my job. I was hoping I would be able to get a disability policy from some company even though I am already pregnant. I have heard a baby gets sicker when put in daycare so soon. I don’t know what to do!!

Take your vacation time then quit. Your not going to want to miss out on your baby growing up. It goes so fast! Just make some cut back in your budget.

In NJ the state disability covers you 4 weeks prior to delivery and then covers you for 6 weeks after delivery for vaginal delivery and 8 weeks for c-section. You can use any vacation time for additional time off. Or if you have any medical conditions (such as post partum depression) your doctor may extend your disability leave. I’m not too sure about California’s standerds, though.
But in NJ its very common for working moms to return to work after 6 weeks of leave. Best of luck and i hope you get the most time available to you to stay home with your baby!
i agree with ^^^^^^ take vacation time and then quit my son is 4 months now and i just put him in day care to go back to work …. i didnt want to do it but i wanted to watch him grow up ya know ….
If your company does offer maternity leave, then they cannot make you use your vacation time. When you speak with your boss, tell him that what are you to do when the child gets sick? Just call in and leave him without someone to do your job? Your child will be more likely to get ill if put into daycare that soon. If you can afford it, I would go onto maternity leave and use up my paid vacation, and then quit. You can find a job that will respect the fact that you are a female and have a family!!
Put in for vacation before the baby is born. Take all of your sick/vacation days and then they cannot deny you maternity leave. It will be paid the six weeks and maybe you could pick up some detail work while you take your vacation time and bank that money. That is a sucky situation, and that sadly seems to be the only way to get all of your disability. My sister sold AFLAC for years, I’ll try to e-mail her and ask if you’d qualify. I think it’s only through employers though. I’dd edit my reply if she writes back. Good luck!
